The concept of landscape has not always existed in human societies; it is a recent cultural construction that did not appear in the Western world until the Modern Age and has subsequently undergone transformation. The legal approach to landscape is an even more recent development that only began when the phenomena of land degradation caused by economic and productive processes raised awareness in society, giving rise to a demand for legal protection. The article examines the emergence, evolution and current vision of the concept and legal nature of landscape, as well as its regulation in positive law.
